These Terms and Conditions (“Terms”) govern your access to and use of the website thereistalent.com, as well as all services provided by PCD Global LLC DBA There is Talent (“There is Talent,” “we,” “us,” or “our”).
By using our website, scheduling a call, or purchasing any service, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and clients.
If at any moment you disagree with any part of these Terms, you should discontinue use of the website and refrain from purchasing our services.
The purpose of these Terms is to ensure clarity about how our services operate, what clients can expect, and the responsibilities of both parties.
There is Talent provides staffing, sourcing, and administrative services by connecting businesses with highly qualified Nearshore Virtual Assistants (VAs) and other remote professionals across Latin America.

While we support the placement and management of administrative processes, clients remain responsible for the day-to-day supervision, task assignment, and training of their Virtual Assistants.
To access or purchase any of our services, you may be required to provide personal and business details, such as:
You confirm that the information you provide is accurate, complete, and up to date. You agree to notify us promptly if any information changes.
Accurate information is essential to ensure proper billing, communication, and service delivery.
Our services operate on a subscription basis. Clients are billed monthly in advance, and billing continues automatically unless canceled.
Your Monthly Plan may be subject to annual price increases aligned with the U.S. Consumer Price Index (CPI).
This adjustment ensures fairness and maintains the value of professional compensation across time.
If you hire additional VAs, they will be billed at the current rate listed on our website for their corresponding category.
This rate may differ from your initial VA’s price depending on market changes, seniority, or specialization.
The Client may request a change of Virtual Assistant (“VA”) at any time should they feel the current VA is not fully meeting expectations. There is Talent will provide a replacement VA that aligns with the Client’s requirements as promptly as possible.
On rare occasions, There is Talent may need to replace a VA due to internal circumstances. In such cases, the Company will inform the Client in advance and manage the transition to ensure continuity of service.
To facilitate a smooth transition when a change of VA occurs, it is recommended that the Client maintain recorded training sessions, documented processes, and clear work guidelines that can be transferred to the new VA.
If you choose to award a bonus or additional payment to your VA:
This centralized process ensures accuracy, documentation, and secure delivery of funds.
All VAs contracted through There is Talent are required to have appropriate hardware to perform their duties, including a computer with sufficient RAM and a stable, high-speed internet connection.
Some Clients may choose to provide additional equipment (e.g., monitor, keyboard). Any such hardware is purchased and supplied solely at the Client’s expense.
Clients may ship hardware directly to their VA from the United States; however, this may incur customs issues, delays, and additional charges. Regulations regarding laptops and mobile phones are particularly strict. For these reasons, this method is not recommended.
Clients may purchase hardware in Colombia through online retailers and have it delivered directly to the VA. This is typically the most efficient option.
There is Talent may assist the Client by purchasing the item locally in Colombia on the Client’s behalf. The Client authorizes the Company to charge the equivalent amount to the payment method on file.
Upon request, There is Talent may ask the VA to sign an acknowledgment agreement stating they will return the item(s) at the end of the contract. The Client understands that such acknowledgment does not guarantee that the equipment will be returned or returned in its original condition.
If hardware must be returned to the Client or reassigned to another VA, There is Talent may assist in arranging shipment at the Client’s cost. Note that major carriers (e.g., DHL) may prohibit shipments of laptops or mobile devices from Colombia to the U.S.
The Client acknowledges that many successful Client, VA relationships occur without the need for additional hardware.
This agreement includes a Buyout Option that allows the Client to contract the Virtual Assistant (VA) directly and discontinue the involvement of There Is Talent.
The Buyout Option may be exercised at any time under the following terms:
The Client understands that There is Talent does not provide any guarantee regarding the duration of the subsequent working relationship between the Client and the VA. The VA may resign or the relationship may terminate for any reason. No refunds will be issued for the buyout fee under any circumstances, even if the relationship proves short-lived. The Client accepts all associated risks.
Once the buyout is completed, the Client is solely responsible for:
There is Talent will cease involvement entirely once the buyout becomes effective.
Clients working with a VA provided by There is Talent agree to:
There is Talent does not manage daily performance metrics, task supervision, or results tracking. Those remain under the client’s responsibility.
There is Talent maintains a Non-Disclosure Agreement (“NDA”) with all VAs, ensuring that no sensitive Client information, such as login credentials, client lists, strategies, trade secrets, or proprietary processes may be disclosed to third parties.
The Company’s policies are designed to safeguard the Client’s confidential information, intellectual property, and commercially sensitive materials at all times.
Beginning on the effective date of this Agreement and continuing for two (2) years after the termination of the Client’s relationship with There is Talent, the Client shall not, directly or indirectly, solicit or hire (whether as an employee, consultant, or contractor) any VA, employee, or officer of There is Talent who provided services to the Client or became known to the Client through the provision of services under this Agreement, without the Company’s prior written consent.
For the same two-year period, the Client shall not introduce or refer any VA, employee, or officer of There is Talent to any third party for the purpose of independent engagement outside of There is Talent.
The Client acknowledges that any breach of this section would cause the Company irreparable harm. Accordingly, There is Talent shall be entitled to seek injunctive relief and any other remedies available under applicable law.
There is Talent may decline or discontinue service if:
These measures protect both our talent and our organization’s integrity.
We strive to maintain accurate pricing and service information across our website and materials. However, mistakes may occur.
In such cases, we reserve the right to:
Clients will be notified before any corrections are applied.
Only the services explicitly listed in your onboarding confirmation email are included in your subscription.
Additional services may require an upgraded plan or separate agreement.
We may delay or refuse service if:
If verification cannot be completed, the order may be canceled and refunded.
The Client’s first payment is processed upon enrollment. All subsequent payments are automatically charged monthly for the same amount unless modified according to these Terms.
To cancel a plan, the Client must notify There is Talent via email at info@thereistalent.com at least seven (7) days before the next scheduled payment date. Failure to provide timely notice will result in the next monthly payment being charged.
Payments collected as a result of late cancellation notifications are non-refundable. If the Client cancels, unused hours for the current billing cycle remain available until the cycle ends.
After twelve (12) months of continuous service, and annually thereafter, payments may increase in accordance with the U.S. Consumer Price Index (CPI).
Any bonus or commission intended for a VA must be coordinated with There is Talent prior to payment. Under no circumstances shall the Client make direct payments to the VA.
If the Client is unable to find a suitable VA after two (2) rounds of interviews, There is Talent will issue a full refund of the initial payment.
You may cancel within 48 hours of purchase for a full refund, as long as no services have been used.
Clients may submit questions or concerns to info@thereistalent.com. We aim to respond promptly and resolve all issues in a fair and transparent manner.
Our website may include links to external sites or platforms.
There is Talent has no control over third-party content or policies, and is not responsible for their practices. Use of external links is at your own discretion.
In rare circumstances, such as natural disasters, political instability, power outages, or other Force Majeure events, service availability and response times may be temporarily affected.
We will notify all clients as soon as possible and take reasonable steps to restore normal operations.
We may update these Terms periodically. If changes are considered significant, we will notify clients before they take effect. Continued use of the site or services after updates constitutes acceptance of the revised Terms.
This Agreement shall be governed by and interpreted in accordance with the laws of the U.S. state in which the Client is located, without regard to conflict-of-law principles.
