These Terms and Conditions (“Terms”) govern your access to and use of the website thereistalent.com, as well as all services provided by PCD Global LLC DBA There is Talent (“There is Talent,” “we,” “us,” or “our”).

By using our website, scheduling a call, or purchasing any service, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all visitors, users, and clients.

If at any moment you disagree with any part of these Terms, you should discontinue use of the website and refrain from purchasing our services.

The purpose of these Terms is to ensure clarity about how our services operate, what clients can expect, and the responsibilities of both parties.

2. Service Overview

There is Talent provides staffing, sourcing, and administrative services by connecting businesses with highly qualified Nearshore Virtual Assistants (VAs) and other remote professionals across Latin America.

Our service includes, but is not limited to:

  • Identifying, screening, and recommending professional candidates
  • Facilitating the hiring and onboarding process
  • Managing subscription billing on behalf of clients
  • Acting as the administrative employer-of-record for payments, bonuses, and related financial transactions
  • Providing ongoing support to help clients maintain a smooth working relationship with their VAs

While we support the placement and management of administrative processes, clients remain responsible for the day-to-day supervision, task assignment, and training of their Virtual Assistants.

3. Purchases and Client Information

To access or purchase any of our services, you may be required to provide personal and business details, such as:

  • Full legal name
  • Email address
  • Phone number
  • Billing information
  • Company details
  • Verification documents if required

You confirm that the information you provide is accurate, complete, and up to date. You agree to notify us promptly if any information changes.

Accurate information is essential to ensure proper billing, communication, and service delivery.

4. Subscription Model

Our services operate on a subscription basis. Clients are billed monthly in advance, and billing continues automatically unless canceled.

4.1 Subscription Billing Cycle

  • Payments are automatically processed every month using the payment method you provide.
  • Your subscription renews monthly unless canceled according to these Terms.
  • Failure to complete payment may lead to temporary suspension or cancellation of services.
  • Reactivation after non-payment may require settling outstanding balances.

4.2 Annual Price Adjustments (CPI Adjustments)

Your Monthly Plan may be subject to annual price increases aligned with the U.S. Consumer Price Index (CPI).
This adjustment ensures fairness and maintains the value of professional compensation across time.

4.3 Pricing for Additional Virtual Assistants

If you hire additional VAs, they will be billed at the current rate listed on our website for their corresponding category.
This rate may differ from your initial VA’s price depending on market changes, seniority, or specialization.

5. Changes of VA

5.1 Client Request for Change

The Client may request a change of Virtual Assistant (“VA”) at any time should they feel the current VA is not fully meeting expectations. There is Talent will provide a replacement VA that aligns with the Client’s requirements as promptly as possible.

5.2 Company-Initiated Changes

On rare occasions, There is Talent may need to replace a VA due to internal circumstances. In such cases, the Company will inform the Client in advance and manage the transition to ensure continuity of service.

5.3 Transition Support

To facilitate a smooth transition when a change of VA occurs, it is recommended that the Client maintain recorded training sessions, documented processes, and clear work guidelines that can be transferred to the new VA.

6. Bonuses and Additional Payments

If you choose to award a bonus or additional payment to your VA:

  • All bonus payments must be processed through There is Talent.
  • We transfer 100% of the bonus amount directly to your VA.
  • A 5% processing and administrative fee applies to bonus transactions.
  • Direct payments to VAs outside our system are not permitted, as they create compliance, accountability, and payment-tracking risks.

This centralized process ensures accuracy, documentation, and secure delivery of funds.

7. Hardware & Equipment Guidelines

7.1 Standard Equipment Provided by VAs

All VAs contracted through There is Talent are required to have appropriate hardware to perform their duties, including a computer with sufficient RAM and a stable, high-speed internet connection.

7.2 Additional Hardware Provided by the Client

Some Clients may choose to provide additional equipment (e.g., monitor, keyboard). Any such hardware is purchased and supplied solely at the Client’s expense.

7.3 Shipping of Hardware from the United States

Clients may ship hardware directly to their VA from the United States; however, this may incur customs issues, delays, and additional charges. Regulations regarding laptops and mobile phones are particularly strict. For these reasons, this method is not recommended.

7.4 Recommended Method: Local Purchase in Colombia

Clients may purchase hardware in Colombia through online retailers and have it delivered directly to the VA. This is typically the most efficient option.

7.5 Assistance from There is Talent

There is Talent may assist the Client by purchasing the item locally in Colombia on the Client’s behalf. The Client authorizes the Company to charge the equivalent amount to the payment method on file.

7.6 Hardware Return Agreement

Upon request, There is Talent may ask the VA to sign an acknowledgment agreement stating they will return the item(s) at the end of the contract. The Client understands that such acknowledgment does not guarantee that the equipment will be returned or returned in its original condition.

7.7 Shipping Returns to the Client

If hardware must be returned to the Client or reassigned to another VA, There is Talent may assist in arranging shipment at the Client’s cost. Note that major carriers (e.g., DHL) may prohibit shipments of laptops or mobile devices from Colombia to the U.S.

7.8 No Obligation to Provide Hardware

The Client acknowledges that many successful Client, VA relationships occur without the need for additional hardware.

8. Buyout Option

This agreement includes a Buyout Option that allows the Client to contract the Virtual Assistant (VA) directly and discontinue the involvement of There Is Talent.

The Buyout Option may be exercised at any time under the following terms:

  • The buyout fee is $2,000 USD.
  • Once the buyout agreement is signed, payment is completed, and the handover process is finalized, the VA will no longer be associated with There is Talent in any capacity and will instead be contracted directly by the Client under the Client’s own terms and conditions.
  • After the buyout becomes effective, the Company will have no further contact with the VA and no ongoing obligations of any kind.

The Client understands that There is Talent does not provide any guarantee regarding the duration of the subsequent working relationship between the Client and the VA. The VA may resign or the relationship may terminate for any reason. No refunds will be issued for the buyout fee under any circumstances, even if the relationship proves short-lived. The Client accepts all associated risks.

Once the buyout is completed, the Client is solely responsible for:

  • Establishing new terms and conditions directly with the VA.
  • Managing the entire working relationship.
  • Compensating the VA for all hours worked.

There is Talent will cease involvement entirely once the buyout becomes effective.

9. Client Responsibilities

Clients working with a VA provided by There is Talent agree to:

  • Provide necessary access to tools, software, and systems
  • Communicate expectations clearly
  • Give guidance, tasks, and feedback
  • Maintain lawful, ethical, and appropriate use of VA time and tasks
  • Avoid assigning tasks related to illegal, harmful, or restricted activities

There is Talent does not manage daily performance metrics, task supervision, or results tracking. Those remain under the client’s responsibility.

10. Confidentiality

10.1 Confidential Information

There is Talent maintains a Non-Disclosure Agreement (“NDA”) with all VAs, ensuring that no sensitive Client information, such as login credentials, client lists, strategies, trade secrets, or proprietary processes may be disclosed to third parties.

10.2 Protection of Business Assets

The Company’s policies are designed to safeguard the Client’s confidential information, intellectual property, and commercially sensitive materials at all times.

11. Non-Solicitation

11.1 Restriction on Solicitation

Beginning on the effective date of this Agreement and continuing for two (2) years after the termination of the Client’s relationship with There is Talent, the Client shall not, directly or indirectly, solicit or hire (whether as an employee, consultant, or contractor) any VA, employee, or officer of There is Talent who provided services to the Client or became known to the Client through the provision of services under this Agreement, without the Company’s prior written consent.

11.2 Restriction on Third-Party Referrals

For the same two-year period, the Client shall not introduce or refer any VA, employee, or officer of There is Talent to any third party for the purpose of independent engagement outside of There is Talent.

11.3 Injunctive Relief

The Client acknowledges that any breach of this section would cause the Company irreparable harm. Accordingly, There is Talent shall be entitled to seek injunctive relief and any other remedies available under applicable law.

12. Right of Refusal & Conflicts of Interest

There is Talent may decline or discontinue service if:

  • The client’s business promotes activities misaligned with our values
  • Tasks requested involve unethical or illegal activities
  • A conflict of interest arises with another client or project
  • There is evidence of abusive or inappropriate treatment toward our VAs or team

These measures protect both our talent and our organization’s integrity.

13. Accuracy of Pricing and Errors

We strive to maintain accurate pricing and service information across our website and materials. However, mistakes may occur.

In such cases, we reserve the right to:

  • Cancel an order
  • Request payment of the correct amount
  • Issue refunds in case of an overpayment

Clients will be notified before any corrections are applied.

14. Order & Subscription Policies

14.1 Scope of Services

Only the services explicitly listed in your onboarding confirmation email are included in your subscription.
Additional services may require an upgraded plan or separate agreement.

14.2 Fraud Prevention

We may delay or refuse service if:

  • Client information is incomplete or unverifiable
  • Fraudulent or suspicious activity is detected
  • Required verification documents are not provided

If verification cannot be completed, the order may be canceled and refunded.

15. Payment Terms

15.1 Monthly Subscription Payments

The Client’s first payment is processed upon enrollment. All subsequent payments are automatically charged monthly for the same amount unless modified according to these Terms.

15.2 Cancellation Notice

To cancel a plan, the Client must notify There is Talent via email at info@thereistalent.com at least seven (7) days before the next scheduled payment date. Failure to provide timely notice will result in the next monthly payment being charged.

15.3 No Refund for Late Cancellation

Payments collected as a result of late cancellation notifications are non-refundable. If the Client cancels, unused hours for the current billing cycle remain available until the cycle ends.

15.4 Annual CPI Adjustment

After twelve (12) months of continuous service, and annually thereafter, payments may increase in accordance with the U.S. Consumer Price Index (CPI).

15.5 Bonus or Commission Payments

Any bonus or commission intended for a VA must be coordinated with There is Talent prior to payment. Under no circumstances shall the Client make direct payments to the VA.

16. Money Back Guarantee

If the Client is unable to find a suitable VA after two (2) rounds of interviews, There is Talent will issue a full refund of the initial payment.

17. Cancellation & Refund Policy

17.1 First-Time Subscription Cancellation

You may cancel within 48 hours of purchase for a full refund, as long as no services have been used.

17.2 Monthly Plans

  • Cancel at any time with 7 days’ notice via email.
  • No further charges will apply after cancellation.
  • Refunds for previous billing cycles are not provided.

17.3 Annual Plans

  • You may cancel at any time.
  • No further annual charges will be applied.
  • Partial refunds for the current annual cycle are not available.

18. Customer Complaints

Clients may submit questions or concerns to info@thereistalent.com. We aim to respond promptly and resolve all issues in a fair and transparent manner.

19. Third-Party Website Links

Our website may include links to external sites or platforms.
There is Talent has no control over third-party content or policies, and is not responsible for their practices. Use of external links is at your own discretion.

20. Service Availability & Force Majeure

In rare circumstances, such as natural disasters, political instability, power outages, or other Force Majeure events, service availability and response times may be temporarily affected.

We will notify all clients as soon as possible and take reasonable steps to restore normal operations.

21. Modifications to the Terms

We may update these Terms periodically. If changes are considered significant, we will notify clients before they take effect. Continued use of the site or services after updates constitutes acceptance of the revised Terms.

22. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the U.S. state in which the Client is located, without regard to conflict-of-law principles.
